Welcome to SLAY. SLAY is an app to complement your friends. We hope that it shows you that there are people who love and admire you.Our terms of use ("Terms") govern access to and use of our app, website, and other tools (together, "SLAY" or the "Service" or "Services"). Every time you access or use SLAY, you agree to these Terms, our Privacy Policy, and all other applicable terms that apply to you. If you do not agree to these Terms, please do not use SLAY.
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service subject to these Terms, our Privacy Policy, and other policies and applicable law.
When you create your SLAY account, you agree that the information you provide is accurate and complete. We may deny you access to the Service if we learn that the information you provided is inaccurate.Using SLAY requires that we first download software to your computer, phone, tablet or other device. You agree that we may automatically update this software and that these Terms and our policies apply to all updates.
You represent that you are at least 13 years old and have the legal capacity to enter into the agreement set forth in these Terms. No one under the age of 13 may use or access SLAY. You may not use SLAY if you do not have the legal capacity to enter into contracts or if doing so would be prohibited under German law.If you are a resident of the European Economic Area ("EEA"), you may only use SLAY if you have reached the age at which you can consent to data processing under the laws of your country or if we have verifiable parental consent for your use of SLAY.
We refer to the photos, comments, links, and other content you post as "User Content." You retain all rights in the User Content you post on SLAY and are solely responsible for it.Although the User Content belongs to you, several important limitations apply:First, the User Content does not include your SLAY username. If you or SLAY terminate your account, you will not retain any rights to the username you used. A new SLAY user may use the username in the future.Second, you grant SLAY and our users a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, store, modify, create derivative works, perform and distribute your User Content for the purposes of using, accessing, operating, developing, and providing SLAY. Nothing in these Terms limits any other legal rights that SLAY may have in User Content, such as under other licenses.Third, we reserve the right to remove or modify User Content or to change the way it is used on SLAY for any reason. This includes User Content that we believe violates these Terms or other policies.Fourth, the content you share with others on SLAY may remain on SLAY even if you leave SLAY. We may secure, archive, and retain your User Content even if you terminate or deactivate your account or delete or remove certain User Content. SLAY and its users may continue to use, store, display, reproduce, pin, modify, and distribute any of your User Content to the extent permitted by these Terms or applicable laws.
You are solely responsible for your User Content and the consequences of posting it on SLAY. You acknowledge that you have all necessary rights, permissions, and consents to post User Content and to grant us the license above.In addition, you agree that your User Content does not violate these Terms or other policies of SLAY, including but not limited to our Community Guidelines, and does not infringe the rights of third parties, including but not limited to copyrights, trademarks, personality rights, or privacy rights.We reserve the right to remove or modify User Content at our sole discretion for any reason, including User Content that we believe violates these Terms or other policies.
W-App will send you SMS or short message service messages, also commonly known as text messages, for two-factor authentication. Please note that message and data rates may apply.
In order to use the Services, you must have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network for which W-App makes the Services available, as well as any carrier services necessary to send text messages, and pay any service fees associated with any such access.Your carrier's text messaging rates will apply to all text message communications made in connection with the services. Accordingly, all pricing, billing, refund, and other related inquiries and support must be directed to your carrier's customer support team.In addition, you must provide all equipment and software necessary to connect to the Services, including but not limited to a mobile handset or other mobile access device that is in working order and suitable for use in connection with the SMS service.
If any upgrade in or to the Services requires changes in your equipment or software, you must effect these changes at your own expense. Unless explicitly stated otherwise, any new or additional features that augment or enhance the current Services shall be subject to these Terms. W-App reserves the right at any time and from time to time to modify, suspend, limit the use of, discontinue, or permanently cancel all or any portion of the SMS Services. W-App uses reasonable efforts to ensure that the Services are always available. However, there will be occasions when the Services will be interrupted for maintenance, upgrades, and emergency repairs or due to failure of telecommunications links and equipment that are beyond our control. By using the Services, you agree that W-App will not be liable to you for any modification, suspension, or discontinuance of the Services.
In order to use the Services, you must opt-in by providing us with your phone number (your "Phone Number") through the Site ("Opt-in"). An invite will then be sent to your Phone Number via SMS message to register for an Account. In addition, if you are not registered for our Services, other Users may send you an SMS message through the App inviting you.You understand, acknowledge, and agree that (i) text message and data rates may apply for any SMS messages sent to you from us, from you to us, or between Users; (ii) you are solely responsible for any fees charged by your wireless provider in connection with SMS messages that you receive or send in connection with the Opt-in and/or the Services; and (iii) you will contact your wireless provider with any questions regarding your text and/or data plan.Once you receive an invite via SMS message and if you choose to continue use of the Services, you will be required to register for an account through the App by providing us with certain information such as your name, school, grade level, gender, phone number, contact book, and photo. In registering for an account, you agree to: (i) provide true, accurate, current, and complete information about yourself; and (ii) maintain and promptly update your account to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your Account and refuse any and all current or future use of the Services. By using W-App and agreeing to these Terms of Use, you acknowledge and consent to the functionality of the platform, which includes the sending of automated notifications from our general number to your contacts as part of the poll creation and voting process. It is understood that the content of these notifications, such as names and school details, is derived from the information provided by the poll creator, who has obtained these details through personal or other legitimate means. Our platform merely facilitates the sending of these messages and does not independently gather or use such information. Your use of W-App signifies your acceptance of this feature and the associated data handling procedures. We employ stringent measures to protect user data and comply with all applicable laws and regulations relating to data privacy and protection. Please note that the sharing or use of information in a manner inconsistent with these terms may result in the suspension or termination of your access to the services.
1. At SLAY GmbH, we prioritize the user experience and active engagement on our platforms. One of the ways we maintain this engagement and keep our users updated is through our SMS service. By signing up and creating an account on our platform, users grant us permission to send SMS notifications as part of the terms of our service. These notifications include information about new features, invites to participate in polls, or updates on our various products. This ensures users stay informed and connected with the dynamic community on our platforms. The SMS service is integral to the SLAY GmbH experience, designed to facilitate real-time, direct communication with our users. We respect and value our users' privacy, and all data used for this service is handled in accordance with our privacy policy and legal regulations.The process of SMS notification enhances the user experience and helps create a vibrant, interactive digital space where our users can freely engage. Remember, these messages are designed to enrich your experience with SLAY GmbH, allowing us to better serve your needs and preferences.
2. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

5. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive not more than 2 messages. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

You are also responsible for the activities that occur on your SLAY account. We recommend that you protect your account with a strong password and do not share it with others. You agree to promptly notify us of any unauthorized access or use of your account or other security breaches.We reserve the right at our sole discretion to restrict or terminate your access to your account for any reason, including but not limited to violations of these Terms or other policies.
You agree to use SLAY only for lawful purposes and to comply with all applicable laws and regulations. You may not use SLAY for illegal activities or share content that violates applicable laws or regulations.If you violate these Terms or other policies of SLAY, we may restrict or terminate your account and/or take legal action against you.
SLAY strives to create a safe environment for all users. However, we cannot guarantee that all users on SLAY are honest and trustworthy. You are solely responsible for your interactions with other users of SLAY. We recommend that you exercise caution and follow our safety tips.
We take the rights of others seriously and encourage you to contact us if you believe that content on SLAY violates your rights. We will carefully review any legal complaints and take appropriate action if necessary.
We may suspend or terminate your license to use SLAY at any time and for any reason. In general, we will provide notice and the reason for termination or suspension. However, our termination or suspension may be immediate and without notice if we, in our sole discretion, believe that you have committed a serious violation of these Terms or our policies.
SLAY is provided "as is" and "as available," without express or implied warranties of any kind. We expressly disclaim all warranties and conditions of any kind, including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.We do not review User Content in advance. SLAY assumes no responsibility and shall have no liability for User Content that you or any other person or third party posts or sends using our Service. You understand and agree that you may be exposed to User Content that is inaccurate, offensive, indecent, abusive, inappropriate for children, or otherwise unsuitable for your purpose.
SLAY offers Users a weekly subscription for an enhanced user experience. If you sign up for a subscription, your subscription will automatically renew until you cancel, and you will automatically be charged the associated fee (plus any applicable taxes) until you cancel. To see your next renewal date and current fee, visit your mobile device’s account settings, or the Subscriptions tab that is available through the Apple App Store.You must cancel your subscription at least 24 hours before the end of your current billing period to avoid being charged for the next billing period. After cancellation, you will have access to your subscription through the last day of your current billing period, at which point your subscription (and access to your subscription features) will be discontinued.You may cancel your subscription any time through your Apple App Store. To access the subscription features after discontinuing your paid subscription, you may need to purchase a new subscription, subject to then-current fees, terms, and conditions.
Payments for your subscription are processed via Apple (“App Provider”) and you will need to provide your App Provider with your payment information. You are responsible for maintaining accurate and up-to-date payment information. If a payment is unsuccessful, we may suspend your access to the relevant subscription features until you provide a valid payment method. SLAY is not responsible if your subscription fails to renew due to invalid payment information.
Refund requests are handled by your App Provider, not SLAY. To request a refund, you should follow your App Provider’s refund procedures. SLAY does not offer refunds for your subscription. If you cancel, we will not issue you a refund or credit for any partial-period access to your subscription. You are not entitled to a refund or credit for any part of a billing period if the Subscription Features are unavailable, defective, experiencing delays, or for any other reason.
We reserve the right to change or discontinue your subscription plans, subscription features, terms, or pricing at any time. SLAY is not responsible for any damage or loss caused by failures or delays of your subscription or the subscription features.
These Terms and all rights and licenses granted herein may not be transferred or assigned by you, but may be transferred by SLAY without restriction. Any attempted transfer or assignment in violation of these Terms is null and void.
If any provision of these Terms is unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. These Terms, together with our Privacy Policy and any additional agreements you enter into with SLAY.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and SLAY's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms are a contract between you and SLAY GmbH. SLAY GmbH is the company that owns SLAY.
